The Service is intended for commercial use by businesses, project developers, consultants, and professionals engaged in or evaluating battery energy storage systems. It is not directed at individual consumers or children.

Ampify acts as the U.S. development and distribution partner for Ampowr B.V., headquartered in the Netherlands. Where personal information is shared with Ampowr B.V. in connection with product inquiries or commercial discussions, this is disclosed in Section 4 below.

2.1  Information You Provide Directly

We collect personal information that you voluntarily submit through the Service, including through contact forms, project inquiry forms, or other communications. This may include:

Ampify does not sell personal information to third parties. We do not share personal information for cross-context behavioral advertising. We may share information in the following limited circumstances:

4.1  Service Providers and Data Processors

We share information with third-party vendors and service providers who perform services on our behalf. These include:

       GoHighLevel, Inc. — our website platform and CRM provider, which processes contact form submissions, stores contact records, and may send emails on our behalf;

       Analytics providers who help us understand how the Service is used;

       Email and communications platform providers; and

       IT and security service providers.

These service providers are contractually obligated to use personal information only as directed by Ampify and to maintain appropriate security measures.

4.2  Ampowr B.V.

As Ampify's manufacturing partner, Ampowr B.V. (Netherlands) may receive project inquiry information where it is necessary to prepare technical proposals, sizing analyses, or product specifications. Where such sharing occurs, it is subject to appropriate data transfer safeguards as described in Section 10 below.

4.3  Legal Requirements

We may disclose personal information if required to do so by law, regulation, legal process, or governmental request, or where we reasonably believe disclosure is necessary to protect the rights, property, or safety of Ampify, its users, or the public.

4.4  Business Transactions

In connection with a merger, acquisition, financing, restructuring, or sale of all or part of Ampify's business, personal information may be transferred as part of the transaction. We will notify affected users as required by applicable law.

 

5.  Cookies and Tracking Technologies

The Service uses cookies and similar technologies to operate, analyze, and improve the website. Cookies are small text files stored on your device. We use the following types:

       Contact form inquiries and project discussions: retained for up to 5 years from last interaction, or longer if a commercial relationship is established;

       Marketing contact records: retained until you opt out, after which we maintain a suppression record to honor your preference;

       Website analytics data: retained in aggregated or anonymized form for up to 26 months; and

       Legal and compliance records: retained as required by applicable law, which may exceed the above periods.

When personal information is no longer required, we delete or anonymize it in accordance with our data retention procedures.

8.2  California Residents (CCPA/CPRA)

       Right to Opt Out of Sale or Sharing: Ampify does not sell personal information or share it for cross-context behavioral advertising. No opt-out action is required, but you may contact us to confirm this practice.

       Right to Limit Use of Sensitive Personal Information: We do not collect sensitive personal information as defined under CPRA.

       Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

8.3  European and UK Residents (GDPR/UK GDPR)
